Welcome to BY:JAMIE.

These Terms of Service (“Terms”) govern your access to and use of www.byjamie.world (the “Website”), together with any products, services, content, digital features and functionality made available through it.

Throughout these Terms, “BY:JAMIE”, “we”, “our” and “us” refer to the owner and operator of this Website.

By visiting our Website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms together with our Privacy Policy and any other policies referenced within them.

If you do not agree with these Terms, you should not use this Website.

Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

 

2. About BY:JAMIE

BY:JAMIE is an independent luxury fashion label producing ready-to-wear garments, leather goods, accessories, bespoke commissions and limited-edition collections.

Our Website is powered by Shopify, which provides the eCommerce platform that enables us to sell our products online. Any contract for the purchase of products is made directly between you and BY:JAMIE, not Shopify.

 

3. Eligibility

To purchase products from our Website you must:

  • be at least 18 years old; or
  • have permission from a parent or legal guardian to use this Website.

By placing an order you confirm that:

  • all information you provide is accurate;
  • you are legally entitled to use the payment method provided;
  • you have authority to enter into legally binding contracts.

We reserve the right to refuse service or cancel orders where we reasonably believe these requirements have not been met.


4. Accounts

Certain features of our Website may require you to create an account.

You agree to:

  • keep your login details secure;
  • provide accurate and up-to-date information;
  • update your information whenever it changes;

Every effort is made to present our products as accurately as possible.

However, colours, textures and finishes may vary depending on:

  • your device;
  • photography lighting;
  • natural characteristics of the materials used.

Many BY:JAMIE products are handmade using natural materials including leather, cowhide, suede and other premium textiles.

As a result:

  • no two pieces will ever be completely identical;
  • natural markings, grain variation and colour differences are expected;
  • these characteristics are part of the product’s authenticity and are not considered defects.

Measurements shown on the Website should be regarded as approximate unless otherwise stated.

Product descriptions, specifications, imagery and pricing may be updated at any time without notice.

We reserve the right to discontinue any product or collection at our discretion.


6. Limited Edition Collections

Many BY:JAMIE products are produced in strictly limited quantities.

Limited availability forms part of the exclusivity of the brand.

We cannot guarantee that products which sell out will ever be reproduced.

Where a product is described as:

  • Limited Edition
  • Exclusive
  • Archive
  • One-of-One
  • Numbered
  • Artist Edition

this does not create any obligation upon BY:JAMIE to manufacture further quantities.

We reserve the right to retire designs permanently.


7. Bespoke & Made-to-Order Products

Certain products are created specifically for individual customers.

These include bespoke garments, made-to-order pieces, customised accessories and commissioned works.

Because these products are produced specifically for you:

  • production will only begin once any required deposit or payment has been received;
  • design approvals provided by you are considered final;
  • measurements supplied by you are your responsibility unless taken directly by BY:JAMIE;
  • production schedules are estimates only.

Once production has commenced, bespoke and made-to-order items cannot be cancelled, exchanged or refunded except where required under applicable UK consumer law.

Minor differences resulting from handcrafting, leather characteristics or artisan techniques do not constitute faults.


8. Pricing

Unless stated otherwise, all prices are displayed in Pounds Sterling (GBP).

Prices include UK VAT where applicable.

International customers remain responsible for:

  • customs duties;
  • import taxes;
  • local VAT or GST;
  • brokerage fees;
  • any additional government charges.

Prices may change without notice.

However, price changes will not affect orders already accepted by us.

Promotions, discounts and promotional codes remain subject to their own terms and may be withdrawn at any time.


9. Orders

Submitting an order constitutes an offer to purchase goods.

Your order is not accepted until BY:JAMIE confirms dispatch of your goods.

We reserve the right to refuse or cancel any order where we reasonably believe:

  • payment cannot be authorised;
  • fraudulent activity has occurred;
  • pricing errors exist;
  • stock has become unavailable;
  • an item has been listed incorrectly;
  • resale or commercial purchasing is suspected.

If payment has already been taken for a cancelled order, a full refund will be issued using the original payment method.

Please review your order carefully before placing it.

Whilst we will always try to help, we cannot guarantee amendments or cancellations once production or fulfilment has begun.


10. Payment

Payment must be received in full before any products are dispatched.

We accept payment methods displayed during checkout.

By placing an order you confirm that you are authorised to use the payment method provided.

Where fraud prevention systems require additional verification, your order may be delayed until verification has been completed.

Ownership of goods remains with BY:JAMIE until payment has been received in full.

11. Shipping & Delivery

We deliver within the United Kingdom and to selected international destinations.

Delivery times displayed on our Website are estimates only and are not guaranteed. Delays may occur due to circumstances outside our reasonable control, including courier delays, customs inspections, weather conditions, industrial action or other force majeure events.

Risk in the goods passes to you upon delivery to the address provided in your order. Title to the goods transfers only once full payment has been received.

Customers are responsible for providing accurate delivery information. We are not liable for delays, additional costs or failed deliveries resulting from incorrect or incomplete address details.

International customers are responsible for ensuring that products may be lawfully imported into their country and for paying any applicable customs duties, import taxes or local charges.


12. Returns & Consumer Rights

Our Returns Policy forms part of these Terms and should be read alongside this document.

If you are purchasing as a consumer within the United Kingdom, your statutory rights under the Consumer Rights Act 2015 remain unaffected.

Ready-to-wear products may be eligible for return or exchange in accordance with our Returns Policy.

The following items are generally excluded from cancellation, return or exchange unless faulty or not as described:

  • bespoke garments;
  • made-to-order products;
  • customised items;
  • personalised products;
  • products altered at your request.

Returned products must be received in their original condition, unworn, unused and with all original packaging, labels and authenticity tags intact.

We reserve the right to refuse returns that do not meet these conditions.


13. Product Care

Many BY:JAMIE products are produced using premium leather, cowhide, suede, silk and other natural materials.

These materials require appropriate care.

Natural ageing, creasing, softening, variations in texture and changes in colour are expected characteristics and should not be regarded as manufacturing defects.

Customers are responsible for following any care instructions provided with their purchase.

Improper storage, cleaning or misuse may permanently damage products and will not be covered by any applicable warranty or returns policy.


14. Intellectual Property

Unless otherwise stated, all intellectual property rights in this Website and its contents belong exclusively to BY:JAMIE.

This includes, without limitation:

  • garment designs;
  • accessories;
  • footwear designs;
  • product concepts;
  • sketches;
  • technical drawings;
  • CAD artwork;
  • graphics;
  • illustrations;
  • scarf prints;
  • textile prints;
  • logos;
  • branding;
  • product names;
  • photography;
  • campaign imagery;
  • videos;
  • written content;
  • website design;
  • downloadable materials.

Nothing within these Terms grants you ownership of any intellectual property rights.

You may not reproduce, distribute, modify, publish, adapt, commercially exploit or create derivative works from any content without our prior written permission.

Unauthorised use may result in legal action.


15. Counterfeit Products

BY:JAMIE actively protects its intellectual property.

The manufacture, sale, distribution or promotion of counterfeit BY:JAMIE products is strictly prohibited.

We reserve all rights to pursue legal remedies against individuals or organisations involved in producing, distributing or selling counterfeit products bearing our branding, artwork or protected designs.


16. Acceptable Use

You agree not to use our Website:

  • to commit fraud;

Although Shopify provides the eCommerce platform used to operate our online store, all purchases are made directly from BY:JAMIE.

Shopify is not responsible for the manufacture, quality, fulfilment, delivery or performance of products purchased from BY:JAMIE.

To the fullest extent permitted by law, you release Shopify from any claims arising from purchases made through our Website.


20. Privacy

Your privacy is important to us.

Our collection and use of personal information is governed by our Privacy Policy.

By using our Website you acknowledge that certain information may be processed by Shopify and carefully selected service providers for the purpose of operating our online store, processing payments, delivering orders and improving our services.

Where permitted by law, our total liability in connection with any order shall not exceed the amount paid by you for the relevant product.

You agree to indemnify and hold harmless BY:JAMIE, its directors, employees, contractors, representatives and service providers against any claims, losses, damages, liabilities, costs or expenses arising from:
